Regulating AI in China: Navigating AI Revolution in the Entertainment Industry

Following our contributions in 2021 and 2022, our Partners John McLellan and Anthony Leung together authored the insightful chapter of “Regulating AI in China” of the International Association of Entertainment Lawyers (IAEL)’s 2024 publication, “The AI Revolution: the International Legal Perspective”.
Drawing on extensive expertise in commercial and entertainment law across Asia, they provide a detailed analysis of China’s current regulatory framework for AI, including the dual-track filing system for algorithmic and generative AI services, and recent legislative developments. The chapter explores key issues such as intellectual property rights, ethics review measures, and landmark court cases addressing AI-generated content. This comprehensive contribution offers valuable guidance for legal professionals, policymakers, and businesses navigating the complex intersection of AI innovation and regulation in China.
The sub-topics covered in the chapter include:
- The regulatory landscape for AI activities
- The lower-tier laws – predictive algorithm and deep synthesis regulations
- The lower-tier laws – interim measures re: Generative AI
- The lower-tier laws – ethics review measures
- Court cases in China involving artificial intelligence and copyright
- Unanswered questions
- Future legislation of artificial intelligence law; Two proposed drafts
